Terms of Use

1. About NextViper

NextViper is an open-source programming language and software ecosystem maintained by Nuratix LLC. The project may include:

• programming language components
• compiler
• interpreter
• runtime
• standard library
• package manager
• package registry
• documentation
• developer tools
• data tools
• numerical computing tools
• AI/ML functionality
• GPU functionality
• APIs
• cloud services

Not every component is necessarily available in every release or service.

2. Open-Source Software

The NextViper source code is distributed under the open-source license included in the repository. The applicable license is available at:

The open-source license governs rights to use, modify, and distribute the applicable source code. Nothing in these Terms is intended to override rights granted by the applicable open-source license.

3. Free Use of NextViper

Subject to the applicable open-source license:

• you may use NextViper without paying a usage fee
• you do not need to request individual permission to use the language
• you may create personal projects
• you may create commercial projects
• you may create software using NextViper
• you may create packages
• you may contribute to the project

Additional cloud or hosted services may have separate terms, limits, or pricing if explicitly stated.

4. Commercial Use

You may use NextViper to develop commercial software subject to the applicable open-source license. Nuratix does not claim ownership of independent software merely because it was created using NextViper.

You remain responsible for complying with licenses applicable to your software, your dependencies, third-party libraries, third-party datasets, third-party models, and third-party services.

5. Accounts

Some Services may require an account. You are responsible for:

• providing accurate information
• protecting your credentials
• maintaining account security
• notifying us of suspected unauthorized access

You must not share credentials in a way that creates unauthorized access.

6. Account Security

You must take reasonable steps to protect your account. Do not:

• share passwords
• expose API keys
• publish private tokens
• commit secrets to public repositories
• intentionally bypass authentication

If you discover unauthorized access, secure the account and report the issue.

7. Package Registry

The NextViper package registry allows developers to publish and distribute software packages. Package authors are responsible for packages they publish. You must not publish packages containing:

• stolen credentials
• malicious payloads
• malware
• unauthorized personal information
• illegal content
• intentionally destructive code
• compromised dependencies
• malicious installation scripts
• content that violates applicable law

8. Package Ownership

Publishing a package does not automatically transfer ownership of your original intellectual property to Nuratix. You must have the necessary rights to publish the package. You are responsible for ensuring that you own the package, have permission to distribute it, dependencies and assets are properly licensed, and trademarks are not misused.

9. Package Licenses

Package authors should include an appropriate license. Package authors are responsible for selecting a license that accurately reflects their rights and intentions. Do not use a license for which you do not have authority.

10. Immutable Releases

Released package versions may be immutable. A published version should not be silently replaced with different content. This protects reproducible builds, dependency resolution, security, package integrity, and downstream projects. Problematic versions may be yanked or marked unavailable.

11. Package Yanking

Nuratix or authorized registry maintainers may restrict or yank packages where reasonably necessary. Examples include:

• malicious packages
• compromised packages
• severe vulnerabilities
• legal requirements
• malware
• copyright violations
• security incidents
• broken packages causing significant ecosystem problems

Yanking does not necessarily mean the underlying release is physically deleted.

12. Package Security

We may perform automated or manual security checks on packages. These checks may include archive validation, path traversal detection, malware scanning where available, metadata validation, dependency checks, package size limits, and checksum verification. Security checks do not guarantee that every package is safe. Users should review packages before using them.

13. Third-Party Packages

Third-party packages are not necessarily written, reviewed, or maintained by Nuratix. Nuratix does not automatically endorse every package published to the registry. Package authors remain responsible for their packages.

14. User Content

You may submit code, packages, documentation, comments, issues, pull requests, examples, and other content. You retain applicable rights in your original content. You grant Nuratix the permissions reasonably necessary to operate the relevant service and display or distribute content you intentionally submit to that service.

15. Open-Source Contributions

NextViper welcomes community contributions (compiler, runtime, standard library, documentation, tests, tooling, performance improvements, bug fixes). Contributions are subject to project contribution requirements.

16. Pull Requests

Submitting a pull request does not guarantee that it will be accepted. Maintainers may accept contributions, request changes, reject contributions, request tests/documentation, modify implementation details, or postpone changes. The final decision to merge belongs to authorized project maintainers.

17. Official Releases

Only authorized maintainers may create official NextViper releases. A community contribution does not automatically become an official release. The release process may include code review, automated testing, security checks, compatibility testing, build verification, artifact generation, checksum generation, signing, and publication.

18. Trademarks and Branding

"NextViper", the NextViper name, logos, and related branding may be trademarks or protected identifiers of Nuratix LLC. The open-source software license does not necessarily grant permission to use trademarks. You may accurately refer to NextViper as the software you use. You must not imply that an independent project is officially endorsed, operated, or sponsored by Nuratix unless authorized.

19. Documentation

Documentation is provided to help users understand NextViper. Documentation may change between versions. Examples are provided for educational and technical purposes. You should verify examples against the version of NextViper you are using.

20. AI and Machine Learning Features

NextViper may provide AI/ML, tensor, data, or GPU functionality. These capabilities may depend on external models, datasets, hardware, GPU drivers, third-party libraries, external APIs, and cloud providers. Nuratix does not guarantee that a particular model, dataset, GPU, API, or third-party service will always be available.

21. User Responsibility for AI Applications

If you use NextViper to build AI systems, you are responsible for the applications you create. You must comply with applicable laws and the terms of third-party services, models, and datasets. Do not use NextViper to violate applicable law or the rights of others.

22. Security Research and Testing

Security testing should be conducted responsibly. Do not intentionally compromise infrastructure, steal credentials, access another user's account, destroy data, bypass security controls, disrupt services, perform DoS attacks, or exfiltrate private information. Authorized security research should follow the applicable security reporting policy.

23. Prohibited Use

You must not use the Services to violate applicable law, distribute malware, steal credentials, compromise systems, attack infrastructure, disrupt services, abuse package infrastructure, distribute malicious packages, impersonate Nuratix/maintainers, upload malicious content, exploit vulnerabilities, or circumvent security controls.

24. Abuse Prevention

We may take reasonable measures to prevent abuse, including rate limiting, account restrictions, package restrictions, temporary suspension, security investigations, blocking malicious traffic, and removing or yanking malicious packages.

25. Service Availability

We aim to provide reliable Services but do not guarantee uninterrupted availability. Services may temporarily become unavailable because of maintenance, infrastructure failures, network failures, security incidents, third-party outages, software failures, or emergencies.

26. Changes to Services

Nuratix may modify, improve, replace, or discontinue parts of the Services. Open-source releases remain subject to their applicable licenses. Hosted services may have additional limitations.

27. Experimental Features

Some features may be experimental. Experimental features may change, break compatibility, be removed, have incomplete documentation, or have performance limitations. Experimental functionality should not be treated as production-ready unless explicitly identified as such.

28. Downloads and Releases

Release artifacts should be obtained from official sources where possible. Users should verify checksums or signatures when provided. Nuratix is not responsible for modified binaries obtained from unofficial mirrors.

29. Installation Scripts

Official installation scripts may download release artifacts. Users should inspect installation scripts when appropriate and use official URLs. Nuratix will make reasonable efforts to provide secure installers but cannot guarantee that every third-party environment is secure.

30. Third-Party Services

NextViper may integrate with third-party services. Third-party services have their own terms, privacy policies, availability, security practices, and usage limits. Nuratix is not responsible for independent third-party services.

31. External Links

The Services may contain links to external websites not controlled by Nuratix. We are not responsible for their content, security, privacy practices, availability, or terms.

32. Intellectual Property

Except for open-source components, third-party components, user content, and content licensed to Nuratix by others, Nuratix owns or licenses applicable rights in its own Services and original project materials. The applicable open-source license governs rights granted to NextViper source code.

33. No Transfer of Ownership

Using NextViper does not transfer ownership of the NextViper project to the user. Likewise, creating software using NextViper does not automatically transfer ownership of that software to Nuratix. Each project remains subject to applicable IP rights and licenses.

34. Copyright

Copyright notices should remain intact where required by applicable licenses. Do not remove required copyright or license notices from third-party software.

35. Third-Party Software

NextViper may include or depend upon third-party software. Third-party software remains subject to its own licenses, which should be documented where required.

36. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND SOFTWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT WHERE A WARRANTY CANNOT LAWFULLY BE DISCLAIMED. TO THE EXTENT PERMITTED BY LAW, NURATIX DISCLAIMS WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

37. No Guarantee of Results

Nuratix does not guarantee that NextViper will meet every use case, software built with NextViper will work correctly, programs will be bug-free, packages will always be available, AI models will produce accurate results, GPU functionality will work on every device, third-party dependencies will remain available, services will remain uninterrupted, or future versions will maintain every behavior.

38. User Responsibility

You are responsible for software you create and deploy using NextViper. This includes application security, data protection, dependency management, compliance, infrastructure, authentication, authorization, backups, monitoring, and deployment configuration.

39. Security Responsibility

Nuratix attempts to maintain secure software and infrastructure. However, no software or online service is completely secure. Users should update software, monitor dependencies, protect credentials, use appropriate security controls, review third-party packages, and report vulnerabilities responsibly.

40. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NURATIX LLC AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF THE SERVICES, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

41. Indemnification

To the extent permitted by applicable law, you are responsible for claims arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another party's rights.

42. Account Suspension

We may suspend or restrict access when reasonably necessary to protect the Services, investigate abuse, prevent attacks, comply with law, protect users, respond to security incidents, or enforce applicable policies.

43. Termination

You may stop using the Services at any time. Account termination procedures depend on the applicable service. Termination does not necessarily remove public package releases, public contributions, or historical records required for ecosystem integrity.

44. Survival

Provisions concerning intellectual property, licenses, security, disclaimers, limitations of liability, dispute-related obligations, and public package history survive termination where appropriate.

45. Changes to These Terms

We may update these Terms. The "Last Updated" date will identify the current version. Material changes may be communicated through appropriate channels where required. Continued use of the Services after an effective update constitutes acceptance of the updated Terms to the extent permitted by applicable law.

46. Governing Law

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with applicable laws governing Nuratix LLC, without giving effect to any choice or conflict of law provision or rule.

47. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved in accordance with applicable legal procedures and jurisdiction designated for Nuratix LLC.

49. Entire Agreement

These Terms apply to the Services that link to them, together with any additional terms specifically applicable to a particular service.

50. Severability

If a provision of these Terms is determined to be unenforceable, the remaining provisions will remain effective to the extent permitted by applicable law.

51. No Waiver

Failure to enforce a provision does not necessarily constitute a waiver of that provision.

52. Language

If these Terms are translated into another language, the English version identified by Nuratix shall be the legally controlling version.

53. Open-Source Community

NextViper is intended to be developed with community participation (bug reports, pull requests, documentation, proposals, packages, tooling, tests, performance). All contributions remain subject to the project's contribution rules and applicable licenses.

54. Official Maintainers

Nuratix LLC and authorized project maintainers control official releases and project infrastructure. Community contributions are reviewed before becoming part of official releases. No contributor should claim to represent Nuratix unless authorized.

55. Independent Projects

Developers may create independent projects using NextViper. Unless explicitly authorized, independent projects should not imply official Nuratix ownership, endorsement, partnership, or sponsorship.

56. Responsible Use

NextViper is a general-purpose programming language. The language may be used to create many types of software. Users remain responsible for how they use the software and for complying with applicable laws.

57. Updates

These Terms may be updated as NextViper and its Services evolve. Always refer to https://nextviper.nuratix.com for the current version.
